Extreme E Trophy Design Competition
TERMS & CONDITIONS
Introduction
- By entering the “Extreme E Trophy Design Competition” (the “Competition”), you accept and agree to be bound by these terms and conditions (these “Terms and Conditions”). Promotional materials relating to the Competition, including all entry instructions, also form part of these Terms and Conditions. In the event of any conflict between any terms referred to in such promotional materials and these Terms and Conditions, these Terms and Conditions take precedence.
- The promoter of this Competition is Extreme E Limited (hereinafter referred to as “Extreme E”) with a company number of 11327724 and a registered address at 9th Floor, 3 Shortlands, London, W6 8DA, United Kingdom.
Entry to the Competition - The Competition is open to individuals living in any country in the world who are of age seven (7) years old or over. Participants under the age of 18 must obtain express permission from a parent or guardian before entering. Employees and agents of Extreme E (or any of its subsidiary or affiliated companies) and anyone otherwise connected with the operation or fulfilment of the Competition, and any member of their immediate families, are not eligible to take part. Extreme E reserves the right to require participants to prove that they are eligible. If a prize winner is found to be ineligible, Extreme E will remain the owner of the prize and reserves the right to award the prize to another participant and to require the return of any prize already awarded.
- The Competition starts on 19 October 2020 at 9:00am GMT and ends on 31 December 2020 at 11:59pm GMT (the "Competition Period"). Entries received outside of the Competition Period will not be eligible to win a prize.
- Winners will be notified by 31 January 2021.
- The Competition will be hosted on the Extreme E Social Media Channels Facebook, Instagram, Snapchat, YouTube, TikTok, Twitter, LinkedIn, Sina and Weibo as well as the official Extreme E website at the following URL address: www.extreme-e.com.
- Participants can enter via the Extreme E website during the Competition Period by uploading their trophy design using the online application form on extreme-e.com/trophychallenge and sharing their post on social tagging @extremeelive and #XETrophyChallenge on the relevant social media channel.
- The selection criteria is further detailed via www.extreme-e.com however creativity, circular economy, technicality and the Extreme E factor; “is the design impactful and does it evoke emotion?” will be taken into account by the judges when selecting the winner.
- Entries submitted by any other means than those described in these Terms and Conditions will not be accepted. Any illegible, incomplete or fraudulent entries will be rejected. The Competition is free to enter and no purchase shall be necessary, but you must have an Internet connection, a valid email address and relevant social media account. Only one entry is permitted per person. Extreme E will check for fraudulent entries when the Competition ends.
The Prize
- There is (one) prize to be won. The winner will receive a replica trophy which will be delivered not later than 30 April 2021. Four (4) other trophies will also be awarded at each X Prix to the 1st, 2nd, 3rd place and the winning team.
- Each prize is as stated and is non-exchangeable, non-refundable and non-transferable. There is no cash alternative. Extreme E reserves the right to substitute the prize with another prize of equal or greater value. The prize will only be awarded to the winners.
The Winner - The one (1) winner will be selected by a panel of 3-5 judges from all eligible entries and notified 31 January 2021 at 10am GMT.
- The choice of the judges is final and cannot be contested.
- The winner will be contacted via the email address and telephone number provided for competition entry within 1 working day of the winner being selected.
- If a winner does not reply to Extreme E as above within 7 days of notification, Extreme E is not obliged to award the prize, in such circumstances a new winner will be selected by a panel of judges. Once the winner sends his/her email to Extreme E (enquiries@extreme-e.com), Extreme E will send the details of the prize, including arrangements for delivery, by return email.
- The winner will be required by e-mail to submit valid identification and proof of eligibility to Extreme E before receiving his/her prize. If for any reason the prize winner does not provide the requested information or is not eligible for the prize, Extreme E will remain the owner of the prize and reserves the right to award the prize to another participant selected at random from the remaining eligible entries.
General - By entering the Competition, participants agree to have their name and country featured in publicity materials relating to the Competition and participate in reasonable promotional activity as may be required by Extreme E in respect of the Competition, without further reference, payment or other compensation.
- Extreme E will collect and process participants’ personal data, including names, contact details, email address and social media username, in order to administer and manage the Competition. On some occasions, Extreme E will ask for consent from participants to use their personal data in a particular way. On other occasions, Extreme E may use personal data for its own legitimate interests, such as for promotional purposes, or when required by law. Personal data will be shared with Extreme E’s agents only to the extent necessary for the prizes to be delivered to the prize winners. Participants’ names and other personal details from their entry to the Competition will be collected and stored by Extreme E and held in accordance with applicable data protection legislation, such as the UK Data Protection Act 2018, and the General Data Protection Regulation (GDPR) 2018. By entering this Competition, each participant consents to the use of their personal data in accordance with these Terms and Conditions.
- Personal data will be kept for as long as is necessary to administer this Competition and a reasonable period thereafter to deliver prizes, resolve disputes and comply with legal requirements. Participants have the right to withdraw their consent and be removed from this Competition at any time or to object to any use of their personal data not required to administer the Competition, unless Extreme E has compelling legitimate interests. Participants also have the right to access, amend, erase or receive a copy of their personal data in a portable form to the extent permitted by law. If participants wish to exercise these rights, they may contact enquiries@extreme-e.com and they may have the right to contact a data protection authority, such as the Information Commissioner’s Office (ICO), if they have any unresolved complaints.
- The design and/or drawing you provide that forms part of your Competition entry must be an original work and must not infringe another person's copyright or other intellectual property rights and by submitting your suggested design and/or drawing, you promise us that this is the case.
- If you are a winner, the design and/or drawing you provided that formed part of your winning Competition entry will become the property of Extreme E on notification of your win. If you are a winner, by submitting your suggested design and/or drawing and entering this Competition you agree to: (i) assign to Extreme E all your intellectual property rights with full title guarantee; and (ii) waive all moral rights, in and to your suggested name to which you may now or at any time in the future be entitled.
- Extreme E reserves the right to modify, cancel, withdraw or suspend the Competition or these Terms and Conditions in whole or in part, at its sole discretion, at any time if circumstances beyond its control make this unavoidable. Extreme E is not responsible for any condition, circumstances, losses, failures or delays caused by events beyond its control.
- To the fullest extent permitted by law, Extreme E (nor any of its affiliate companies, employees, directors, employees, agents, assigns or sub-contractors) excludes liability for any damage, loss, injury, claims incurred or disappointment suffered by any participants' entry into the Competition or their acceptance, receipt and/or use or misuse of a prize. Extreme E is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any e-mail, social media or other means of entry to be received on account of technical problems or traffic congestion on the internet, telephone lines or at any website, or any delay or failure of any postal or equivalent delivery service, or any combination thereof, including any injury or damage to a participant’s computer or electronic device related to or resulting from participating in the Competition. Nothing shall exclude Extreme E’s liability for fraudulent misrepresentation, death or personal injury as a result of the gross negligence of Extreme E, or any other liability that cannot be excluded or restricted by law.
- Any participant who enters, attempts to enter or participates in the Competition in a manner, which in Extreme E's reasonable determination is contrary to these Terms and Conditions (including in respect of eligibility) or by its nature is unjust to other participants (including without limitation tampering with the operation of the Competition, entering using fraudulent means, cheating, hacking, deception or abusing, offending, upsetting threatening or harassing any other participants or Extreme E) may be suspended or disqualified from the Competition at Extreme E’s sole discretion without prior notice. Entries, comments, tweets and posts in respect of the Competition must be socially responsible and must not incentivise, encourage or condone irresponsible behaviour. They will be moderated daily and any content, suggestions or names deemed by Extreme E to be inappropriate, offensive, obscene, defamatory, insulting, violent, disrespectful or upsetting will be removed. Any such entries, comments or posts will not constitute valid entry into the Competition. Persistent commenting of such nature will see the offending user blocked from the page and disqualified from the Competition.
- This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, Snapchat, YouTube, TikTok, Twitter, LinkedIn, Sina or Weibo. Participants acknowledge that Facebook, Instagram, Snapchat, YouTube, TikTok, Twitter, LinkedIn, Sina or Weibo shall not have any liability to them in connection with the Competition. Eligible participants understand and agree that they are providing their information to Extreme E and not to Facebook, Instagram, Snapchat, YouTube, TikTok, Twitter, LinkedIn, Sina or Weibo. By entering this Competition, each eligible participant releases Facebook, Instagram, Snapchat, YouTube, TikTok, Twitter, LinkedIn, Sina or Weibo from any action or claim arising out of the Competition. Any questions, comments or complaints regarding this Competition must be directed to Extreme E.
- All decisions of Extreme E in relation to the Competition are final and Extreme E are not obliged to enter into any correspondence with participants. No message whether written or electronic, will be sent to non-winning participants.
- The unauthorised reproduction, representation or use in any way of all or part of elements relating directly or indirectly to the Competition, and any brands, logotypes or trademarks is strictly prohibited. All trademarks, logos and any other intellectual property rights are and shall remain the property of their respective owners.
- The Terms and Conditions may be sent by mail free of charge to any person who requests them from Extreme E in writing and can also be consulted and downloaded on the Extreme E website; at the following URL address: www.extreme-e.com at any time during the Competition Period.
- All disputes, claims, issues and questions concerning the Competition and these Terms and Conditions, or the rights and obligations of the participants and Extreme E in connection with the Competition, shall be governed by, and construed in accordance with, the English law. Each participant agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Competition or these Terms and Conditions.
